Times are Changing and so are the Life Insurance Companies

Within the past two decades, we have seen what was considered to be an illegal drug across all 50 U.S. states become now legalized in 29 states for medicinal use and 8 U.S. states for recreational use. Marijuana has also been decriminalized in several U.S. states. As time goes on we can only assume this list will continue to grow with more states legalizing the use of marijuana.

With the rapid changes in marijuana laws, life insurance companies are also making rapid changes to the way they underwrite and approve the use of medical marijuana, as well as the use of recreational marijuana.

U.S. States where medical marijuana is legal:

Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Montana, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Dakota, Ohio, Oregon, Pennsylvania, Rhode Island, Vermont, Washington, West Virginia including Washington D.C.

U.S. States where recreational marijuana is legal:

Alaska, California, Colorado, Maine, Massachusetts, Nevada, Oregon and Washington including Washington D.C.

It should be noted that your state does not need to be on this list to qualify for life insurance coverage.

Do Marijuana Users Qualify for Smoker or Non-Smoker Rates?

This is a frequently asked question that we get from our consumers that use marijuana. Qualifying as a smoker or a non-smoker will depend on the life insurance company being applied with. A couple factors that will be considered such as:

THC – Tetrahydrocannabinol otherwise known as THC for short is commonly tested for in the urinalysis portion of the life insurance medical exam. There are plenty of life insurance companies that will allow you to test positive with THC in your lab results but most of the life insurance companies want to see a negative THC result for non-smoker rates.

Medical Use – Medicinal marijuana prescribed by a medical professional can qualify for non-smoker rates with some companies. The issue with medical marijuana use will be the medical reason why you have been prescribed it. Medical marijuana is often prescribed to help treat medical conditions such as Cancer, Glaucoma, HIV/AIDS, Parkinson’s, Multiple Sclerosis, Epilepsy, Seizures, Wasting Syndrome, Crohn’s Disease and PTSD to name a few. Some medical conditions might be considered as high risk which can lead to a table rated policy. However, a table rated policy will be much cheaper than a table rated smoker policy.

Recreational Use – Recreational marijuana use with many life insurance companies can qualify for excellent rates depending on the frequency. Frequency is the key if you smoke marijuana. If you are someone who smokes every day, it will be near impossible to get non-smoker rates, let alone life insurance coverage period.

When you Apply for Life Insurance with Marijuana Use

When it’s time to apply for your life insurance coverage the most important thing to remember is to be 100% honest on all questions of the insurance application and exam. Regardless of your state’s current laws on marijuana use, the Health Insurance Portability & Accountability Act (HIPPA) protects your disclosed information from being released this includes law enforcement, employers or family members. It’s completely private information between you and the insurance company.

Medical Exam – The second portion of any traditional life insurance application is the paramedical exam. The paramedical exam will consist of general questions related to your health, as well as your parents and siblings health. The exam will also require a blood and urine sample. The urine sample will be used to test for Tetrahydrocannabinol (THC). For the best rates, most insurance companies will want to see a negative THC result. Keep in mind that THC can be detected in the urine anywhere from 3-40 days.

Drug Questionnaire – Since marijuana is classified as a drug, you will be required to fill out a drug questionnaire. The drug questionnaire is a one page form that will consist of details regarding usage.

Prescription Check – The prescription check gives the life insurance company insight on all and any prescription prescribed to you. If you have been prescribed medicinal marijuana, this will show on the prescription check.
